Ce contrat de licence encadre l'utilisation de l'application iOS Suncam. En la téléchargeant, en l'installant ou en l'utilisant, vous l'acceptez.

Ce que fait l'application
Suncam aide les photographes à préparer leurs prises de vue : position du soleil et de la lune, heures de lever et de coucher, golden hour et heure bleue, visualisation en réalité augmentée, et analyse du relief qui masque le soleil.
Licence
Il vous est concédé une licence personnelle, non exclusive, non transférable et révocable d'utilisation de Suncam sur les appareils Apple que vous possédez ou contrôlez, conformément aux Règles d'utilisation de l'App Store. L'application vous est concédée sous licence, elle ne vous est pas vendue. Vous vous engagez à ne pas la copier, la modifier, la distribuer, la décompiler ni en pratiquer l'ingénierie inverse, sauf dans les limites autorisées par la loi.
Essai gratuit et achat
L'application offre un essai gratuit de 7 jours à compter du premier lancement, donnant accès à toutes les fonctionnalités, sans engagement ni moyen de paiement. À l'issue de l'essai, l'utilisation se poursuit par un achat unique de 7,99 € (prix indicatif en France : il varie selon le pays et peut évoluer ; le prix qui fait foi est celui affiché par l'App Store avant validation). Il s'agit d'un achat définitif : il n'existe aucun abonnement ni prélèvement récurrent. L'achat est rattaché à votre identifiant Apple et peut être restauré gratuitement sur vos appareils depuis le bouton « Restaurer mes achats ».
Qui vend l'application
La vente est réalisée par Apple Distribution International Ltd., vendeur (merchant of record) pour l'Europe. Le paiement, la facturation et les éventuels remboursements relèvent donc d'Apple et de ses conditions, et non de l'éditeur : les demandes se font sur reportaproblem.apple.com. Conformément à l'article L. 221-28 du code de la consommation, le droit de rétractation ne s'applique pas à un contenu numérique fourni immédiatement, ce que vous acceptez en confirmant l'achat ; cela ne fait pas obstacle à la politique de remboursement volontaire d'Apple.
Exactitude et responsabilité
Les éphémérides sont calculées localement à partir d'algorithmes astronomiques reconnus et vérifiées contre les données de l'US Naval Observatory. Les données de relief proviennent d'un modèle tiers d'environ 30 mètres de résolution, qui peut comporter des imprécisions. Suncam est un outil de préparation photographique, en aucun cas un instrument de sécurité ou de navigation. L'éditeur ne saurait être tenu responsable des conséquences d'une utilisation en montagne, en mer, de nuit ou dans toute situation où une erreur d'horaire, d'azimut ou d'altitude pourrait présenter un danger. Dans les limites permises par la loi, l'application est fournie « en l'état », sans garantie de disponibilité continue des services tiers dont elle dépend.
Le rôle d'Apple
Ce contrat est conclu entre vous et l'éditeur uniquement, non avec Apple. Apple n'est tenue à aucune obligation d'assistance ou de maintenance concernant l'application : toute question doit être adressée à l'éditeur. En cas de non-conformité à une garantie applicable, vous pouvez en informer Apple, qui pourra vous rembourser le prix d'achat ; au-delà, Apple n'assume aucune autre obligation. Apple et ses filiales sont tiers bénéficiaires de ce contrat et peuvent en exiger l'exécution à votre encontre. Vous déclarez ne pas être situé dans un pays sous embargo américain ni figurer sur une liste de parties interdites.
Résiliation
Le contrat s'applique jusqu'à sa résiliation. Il prend fin automatiquement en cas de manquement de votre part. Vous pouvez y mettre fin à tout moment en désinstallant l'application.
Litiges
Le présent contrat est régi par le droit français. En cas de différend, une solution amiable sera recherchée en priorité. Le consommateur peut recourir gratuitement au médiateur de la consommation : CNPM - Médiation - Consommation, 27 avenue de la Libération, 42400 Saint-Chamond (cnpm-mediation-consommation.eu). À défaut d'accord, les tribunaux français sont compétents.

What the app does
Suncam helps photographers plan their shoots: sun and moon positions, sunrise and sunset times, golden hour and blue hour, an augmented reality view, and analysis of the terrain that blocks the sun.
Licence
You are granted a personal, non-exclusive, non-transferable and revocable licence to use Suncam on Apple devices you own or control, in accordance with the App Store Usage Rules. The app is licensed to you, not sold. You agree not to copy, modify, distribute, decompile or reverse-engineer it, except as permitted by law.
Free trial and purchase
The app offers a 7-day free trial from first launch, giving access to every feature, with no commitment and no payment method required. After the trial, continued use requires a one-time purchase of €7.99 (indicative price in France: it varies by country and may change; the binding price is the one shown by the App Store before you confirm). This is a final purchase: there is no subscription and no recurring charge. It is tied to your Apple Account and can be restored free of charge on your devices via the “Restore purchases” button.
Who sells the app
The sale is made by Apple Distribution International Ltd., acting as merchant of record for Europe. Payment, invoicing and any refunds are therefore handled by Apple under its own terms, not by the publisher: requests go through reportaproblem.apple.com. Under article L. 221-28 of the French consumer code, the right of withdrawal does not apply to digital content delivered immediately, which you accept when confirming the purchase; this does not affect Apple's own refund policy.
Accuracy and liability
Ephemerides are computed locally using established astronomical algorithms and verified against US Naval Observatory data. Terrain data comes from a third-party model with a resolution of about 30 metres, which may contain inaccuracies. Suncam is a photography planning tool, never a safety or navigation instrument. The publisher accepts no liability for the consequences of use in the mountains, at sea, at night, or in any situation where an error in time, azimuth or elevation could be dangerous. To the extent permitted by law, the app is provided “as is”, without any guarantee of continuous availability of the third-party services it relies on.
Apple's role
This agreement is between you and the publisher only, not Apple. Apple has no obligation to provide maintenance or support for the app: any question should be addressed to the publisher. If the app fails to conform to an applicable warranty, you may notify Apple, which may refund the purchase price; beyond that, Apple has no further obligation. Apple and its subsidiaries are third-party beneficiaries of this agreement and may enforce it against you. You represent that you are not located in a country subject to a US embargo and are not on any prohibited party list.
Termination
This agreement applies until terminated. It ends automatically if you fail to comply with it. You may end it at any time by uninstalling the app.
Disputes
This agreement is governed by French law. In the event of a dispute, an amicable solution will be sought first. Consumers may use the consumer mediator free of charge: CNPM - Médiation - Consommation, 27 avenue de la Libération, 42400 Saint-Chamond. Failing agreement, the French courts have jurisdiction.
